1. Who We Are & Agreement

Babu (“Be A Better U”) is an all-in-one coaching platform, available at babuonline.co.uk, that lets fitness coaches run client management, training and diet plans, courses, check-ins, real-time chat, and payments from one place, with a branded app for their clients.

These terms form an agreement between you and Babu. By creating an account, subscribing to a plan, or otherwise using the Services, you accept these terms in full. If you do not agree with them, please do not use the Services. Where you are accepting these terms on behalf of a coaching business, you confirm you have the authority to bind that business.

2. Accounts

Babu has two kinds of account. A coach account (a “tenant”) is the coaching business itself, with its own branded space, client roster, and billing. A client account belongs to someone a coach is training, and sits inside that coach’s tenant.

You must provide accurate, current information when you register, and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Tell us straight away at [email protected] if you suspect unauthorised access.

For a coach account, the account owner (the first user set up on the tenant) controls billing — choosing the plan, updating payment details, and managing the subscription — even where other team members have day-to-day access to the account.

3. Plans & Billing

Babu offers three plans for coaches:

• Starter — £11.99/month, for up to 10 active clients, with 0% transaction fees.
• Pro — £44.99/month, for up to 50 active clients, with 0% transaction fees.
• Enterprise — a custom plan arranged directly with us, with unlimited active clients and percentage-based transaction fees instead of a flat monthly price.

Starter and Pro come with a 14-day free trial and no card is required to start it. During the trial, a percentage-based platform fee applies to payments your clients make through Babu; this fee is shown in-app before you subscribe. Once you subscribe to a paid plan, that trial platform fee drops to 0% — you keep everything you earn on Starter and Pro, subject only to standard Stripe processing costs.

All subscription and client payments are processed by Stripe. We may change our prices from time to time; where we do, we will give you reasonable notice before any change takes effect on your account.

You can cancel your subscription at any time. Cancelling stops future billing, but you keep access to the Services for the remainder of the period you have already paid for.

Starter and Pro are capped at their stated number of active clients. If you reach your plan’s limit, new client sign-ups pause until you upgrade or free up a space — we will never remove an existing client from your account because you are at the limit.

4. Coach–Client Relationship

Coaches using Babu are independent businesses. Babu provides the software that coaches use to run their business; we are not a party to the coaching relationship or any contract between a coach and their client, and we do not supervise, endorse, or guarantee the training, diet, or supplement advice a coach gives.

Coaches are solely responsible for the advice and plans they provide to their clients, for the accuracy and safety of that advice, and for how they handle client payments, pricing, and refunds within their own business.

5. Acceptable Use

You agree to use the Services lawfully and in good faith. In particular, you must not:

• post or send abusive, harassing, or unlawful content to other users, including through chat, check-ins, or community features;
• infringe the intellectual property or other rights of Babu, coaches, clients, or any third party;
• interfere with, disrupt, or attempt to circumvent the security or normal operation of the Services; or
• resell, sublicense, or otherwise make the Services available to third parties outside your own coaching business, except through the ordinary use of your client accounts.

We may suspend or terminate accounts that breach this section.

6. Content & Intellectual Property

Coaches retain ownership of the content they create and upload — training plans, diet plans, courses, documents, and other materials. By uploading content, you grant Babu a licence to host, store, process, and display it as needed to operate the Services and deliver it to your clients.

Babu and its licensors own the platform itself — the software, design, and branding of Babu — and nothing in these terms transfers that ownership to you.

7. Availability & Changes

We work hard to keep the Services available and reliable, but we do not guarantee uninterrupted or error-free uptime. We may update, improve, or change features of the Services over time, including adding or retiring functionality, as the platform evolves.

8. Liability

The Services are provided on an “as is” basis. To the fullest extent permitted by law, our total liability to you arising out of or in connection with these terms or your use of the Services is capped at the fees you have paid to us in the 12 months before the event giving rise to the claim.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

9. Termination

Either you or Babu may end this agreement at any time — you by cancelling your subscription or closing your account, and we by suspending or terminating accounts that breach these terms or, with reasonable notice, for other legitimate business reasons.

When an account is terminated or closed, we will give you a reasonable window to export your data before it is deleted from our systems, save for anything we are required to retain for legal or accounting purposes.

10. Governing Law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from them.
